Construction Accidents

This area of litigation consists primarily of premises liability and negligence lawsuits against (i) general contractors, (ii) contractors other than the employer of the injured worker, and (iii) owners of construction work sites that failed to maintain a safe work environment. It is a particularly important area of litigation for people whose only other recourse is workers' compensation.

The Firm has successfully resolved the cases of a number of workers who have been injured on construction sites, including sheet metal workers, iron workers, and carpenters. We have obtained settlements of, in some cases, substantially higher than $1 million. In these cases the general contractor was found negligent for failing to make the work site safe for workers.

The firm has also successfully pursued manufacturers of defective construction equipment. For instance, The Firm has represented a construction worker who suffered a cumulative trauma disorder as a result of working with heavy equipment and construction tools.

Attorneys at The Firm have expertise in construction safety and knowledge of the numerous OSHA regulations concerning construction safety and health. The firm supported the lengthy process that resulted in Cal/OSHA finally implementing a multi-employer work site rule requiring all contractors on a site to take responsibility for safety and health.
